Exemptions To Providing A

Homebuyer Report”

We have been asked about a Homebuyer Report and whether it is required on a specific property. This building is in Scotland and as the law is geographic/jurisdiction specific, the following observations relate to Scots Law. We shall endeavour to cover the law for other nations within the UK in due course.

Please note that although the managing director of Unique Property Bulletin Ltd., spent a number of years in service as a law officer and has reasonable credentials in the subject (here and here), as one reader humorously phrased it as, being “a lawyer with handcuffs” – the undernoted excerpts from statute are included only to help with the veracity of an OPINION.

Unique Property Bulletin Ltd., would recommend that if you are in any doubt, please consult your own, independent legal counsel.

From our perspective, rather than deploy exemptions which are definitive and in the undernoted cases legally precise, we would tend to favour securing a “Homebuyers Report” even if the exemptions apply. That way there can be no groaning by people who do not seem to understand the law.

Last but not least, there are many articles online (including this brief summary). However, we have observed that learned property professionals have published inaccurate information on this subject. So our advice is ALWAYS go to the original source. In this case that is the statute as filed by the recognised archive and direct from Parliament and Royal Assent (source link at the end of this article). Any questions, please feel free to get in touch (here).
